Chauffeurs' Insurance
Puerto Rico Employees
By a government mandated insurance plan, Employers in Puerto Rico must insure any nonexempt employee whose work requires the employee to drive a “motor vehicle” as part of that employee’s regular duties. This includes a delivery truck driver and a forklift operator at a warehouse.
The employees covered under the Chauffeurs’ Social Security Act are not covered by SINOT.
The Chauffeurs’ Social Security Act requires that an employer reserve the employee’s position for one year and reinstate their position if requested by the employee within 30 working days from release from treatment and such petition is made within one year from the beginning of the disability; the employee is mentally and physically capable to occupy the position; and the position is available at the request for reinstatement.
A summary of the Chauffeurs’ Social Security Act was provided by the Department of Labor in 2019.
Chauffeurs’ Insurance is different from Worker’s Compensation Insurance, which is a separate government mandated insurance for employers in Puerto Rico that is applicable to certain employees.
